Applicability to entrepreneurs and definitions of terms

(1) The following terms and conditions apply to all deliveries in their version valid at the time of the order. Conflicting or differing terms and conditions do not apply, in case of doubt then the legal regulation applies.

(2) "Consumer" for the purposes of these terms and conditions is any natural person who concludes a legal transaction for a purpose that can be attributed to neither their commercial nor their independent professional activity.

1. Conclusion of the purchase contract, delivery time, retention of title

All offers on the Internet or in catalogs are non-binding. Your order is an offer to us to conclude a purchase agreement for certain goods at the price valid on the order date. The purchase contract is concluded with our written (sent by email) order confirmation, at the latest with the dispatch of the goods.

You can find out the current, expected delivery time in the shopping cart / checkout or in the description of the shop product. This is not binding. Generally, our delivery time within Germany is about 3 - 4 working days (Monday - Saturday, except public holidays). We reserve the right to ship the goods only after expiry of the withdrawal period (see below).

Until full payment, the goods remain our property.

2. Delivery and shipping costs

Standard shipping is by DHL. We charge 5.90 € shipping within Germany. For partial deliveries, the shipping costs apply of course only once. For deliveries to Austria, shipping costs of 16.99 € occur.

For international orders, the shipping costs depend on the size and weight of the package. For deliveries to countries outside the European Union, any applicable taxes and duties must be borne by you. Shipping costs, COD charges, taxes and customs duties can not be refunded.

If a certain item is not available, we reserve us the right to send you a replacement item - equally priced and of equal quality. If you do not want to accept or keep it, you can return it to us free of charge.

3. Payment options

In our online shop, you can choose the payment method, which is displayed during the checkout process. Basically there is the possibility to pay by credit card, immediate transfer, PayPal or prepayment. The opportunity of discount deduction does not exist. In order to hedge our own credit risk, we reserve the right to offer only certain payment methods according to the respective creditworthiness.

4. Online settlement of consumer disputes

At ec.europa.eu/consumers/odr/ you will find information on the out-of-court settlement of consumer disputes in online commerce.

5. Returns

For all purchases from our online shop assortment, we grant you, in addition to the statutory right of withdrawal, a statutory return rights of a total of 14 days from the reception of goods. If you return the goods to us within 14 days after reception, you will be released from the purchase contract. The goods must be complete, in the original packaging and must be in unused and undamaged condition.

Please refer to the contact information in our general terms and conditions below. The contractually granted return guarantee leaves your legal rights and claims unaffected. The statutory right of withdrawal and the statutory warranty claims remain with you without restriction.

The costs of the return must be borne by you. Unfree sent packages can not be accepted.

Please do not forget to have the confirmation slip stamped and keep it until you have received a confirmation email that your package has arrived.

Therefore we dissociate ourselves hereby expressly from all contents of third-party linked pages on https://www.ea-st.com/ and do not adopt these contents as our own. 7. Image rights

All image rights are owned by e.St Retail GmbH. Use without expressed permission is prohibited. In the case of unauthorized use of our pictures, we reserve ourselves the right to take legal action.

8. Applicable law; place of jurisdiction

The law of the Federal Republic of Germany applies to all legal transactions or other legal relationships with us. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and any other intergovernmental agreements, even after their incorporation into german law, shall not apply. For contracts for a purpose that can not be attributed to the professional or commercial activity of the claimant (contract with consumers), this choice of law shall apply only to the extent that the granted protection by mandatory provisions of the law of the state in which the consumer has his habitual residence, is withdrawn.

In commercial transactions with merchants and legal persons under public law, the place of jurisdiction for all disputes concerning these terms and conditions and their validity of individual contracts, including bills of exchange and checks, the place of jurisdiction of the registered office of ea.St Retail GmbH (AG MÜHLDORF / LG TRAUNSTEIN) shall be agreed. In this case, we are also entitled to sue at the customer's domicile.

9. Severability clause

Should individual provisions of the contract, including these provisions, be or become wholly or partially invalid, or should the contract have an unforeseen loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. Instead of the ineffective or missing provisions, the respective statutory regulations apply.
